Tax Litigation Support Services Print

Mercury Tax provides specialist tax litigation support services to individuals and companies that are involved in disputes with HMRC. We have years of risk management experience. So, if there is a tax angle in a commercial litigation matter, we are good people to speak to.

We have significant experience of preparing appeals to the tax tribunals. Andy Wells (click here for CV) has acted as an independent expert and given evidence in the High Court; we write comprehensive (and comprehensible) reports in accordance with CPR best practice, that may be used in evidence and will be readily understood by a Judge; we can provide pre-action advice for fixed fees, whether instructed by claimants, defendant firms or their insurers, usually via their legal tams. Because we are independent and we do not restrict ourselves to advising claimant or defendants exclusively, we can frequently spot the angles and anticipate the arguments that may be developed by both sides.

When we give an independent opinion, it will be supported by facts and experience. There is no reason to think it might change – although we are not dogmatic when presented with a valid alternative point of view. As we do not have retained audit accounting or tax compliance clients, we should rarely encounter conflicts of interest. We will not accept instructions that are beyond our sphere of expertise, but if that situation should arise we will usually know someone else with the skills and litigation experience that could assist.

Whenever instructed we will agree realistic timetables that we will adhere to. We recognise that instructing lawyers dislike 11th (or 13th!) hour delivery; unexpected changes in advice or opinions, and fees that are quoted at unrealistic levels and subsequently negotiated. We will be transparent as regards our costs and will honour agreed quotations.
